The following includes a condensation and clarification of the legal language in Articles VI and VII.1c of the Windemere Master Declaration of Covenants and Restrictions and other Windemere rules.
All Windemere property shall be used exclusively for single-family residential purposes.

Be reminded, the Windemere pool has no lifeguard on duty at any time.
Swimming pool/game court keys may be obtained from the Association Treasurer. A $35 deposit is required. A fee of $75 will be charged to replace lost keys. Keys can be replaced no more than two times.
Pool hours are sunrise to 11:00 p.m. during the April-September swimming season.
The pool is for Windemere residents, their immediate family members and guests. Immediate family means parents, siblings, children, and grandchildren.
Guests must be accompanied by a resident member or have prior written permission from the WHOA Board of Directors to use pool.
All children under the age of 18 must be accompanied at the pool by an adult at all times.
Association members must inform guests and family of the pool rules. Members are responsible for the actions of their guests and family.
Pool Parties – Parties of Six or more guests require written permission from the WHOA Board of Directors. Request forms may be obtained from the Association Secretary. Completed request forms must be received by a WHOA Board Member at least one week prior to the date of party.
NO MORE THAN FIFTEEN (15) CHILDREN UNDER THE AGE OF 18 PER PARTY. ONE ADULT SUPERVISOR PER FIVE (5) CHILDREN MUST BE AT POOLSIDE THROUGHOUT.
Tables, chairs and poolside areas cannot be reserved during the swimming season. First arrivals get first choice. Members cannot reserve the pool area to the exclusion of others during the swimming season. The pool may be reserved anytime during the off-season (October-March). The pool gets heavy use during weekends and holidays.
No glass is permitted in or around the pool at any time, including glass drink containers. Coins, rocks, balloons, and similar small objects must be kept out of the pool; they can cause damage to pool filter equipment.
No Smoking is allowed at the pool by City of Arlington ordinance.
Audio equipment – Use earphones or turn the volume low so as to not be disturbed others at the pool.
Pool Gates / Doors - For the safety of all members and guests utilizing the pool area, gates and restroom doors must remain closed and locked at all times. This is also required by City of Arlington ordinance.
Pets are not allowed inside the pool area.
Pool Maintenance – The pool belongs to Association members. Members are responsible for assuring the pool area remains clean at all times.
The Association is not responsible for personal items left at the pool.
Reckless or disruptive conduct at the pool, as well as violators of WHOA rules, should be reported to a Board member (listed in the Association directory). Emergencies and obvious violations of the law should be reported to the police and the Board. Telephones for emergency use only are located in the enclosed northeast cabana and outside the west gate to the pool.
Tennis / Game Courts
Non-resident Windemere Homeowners may use the pool and courts, provided they pay a $35.00 key deposit and a $140.00 annual user fee.
Parking Restrictions

Exterior Holiday Decorating – Holiday displays are allowed in the Common Area fronting a homeowner’s property starting the day after Thanksgiving and ending January 10 each year. Displays should contain no elements of sound.
Garden walls surrounding each property are the responsibility of the homeowner. Shared walls are the responsibility of both homeowners.
Garden maintenance – Individual gardens should remain free of debris and be maintained in a manner, and with such frequency, as is consistent with good property management. No debris/soil should rise above the foundation line of a neighboring property within the garden area.
Trash collection days are Wednesday and Saturday. Trash and/or trash containers must not be stored behind homes within view. City ordinance prohibits putting trash at the curb before 7:00 p.m. the night before collection.
Recycling bins must be kept within residential walls prior to Wednesday collection days. Bins should be placed along the alleyway behind the home the morning of, or the night before, collection day. Bins must be removed from alleyways by nightfall the day of collection.
Towing Policy of the Windemere Homeowners Association

The Windemere Board of Directors has received numerous complaints about residents not complying with the parking regulations outlined is the Windemere Master Declaration of Covenants and Restrictions. The Board has repeatedly requested violators to follow the rules, especially not parking on streets and alleyways overnight. Because some residents continue to ignore requests to abide by the parking rules, the Board finds it necessary to revise the policy and procedures when towing illegally parked vehicles.
Vehicles may be towed at owner’s expense if they are illegally parked in accordance with the Windemere Homeowners Association Parking Regulations. See the applicable Article of the Master Declaration of Covenants and Restrictions below.
Article VII, Section 1 (h) of the Windemere Master Declaration of Covenants and Restrictions states:
“No boats, trucks, campers, or vans and no commercial type vehicles shall be stored or parked on any Lot except while parked in a closed garage, nor parked on any street in or adjacent to the property except while engaged in transporting people or items of personal property to or from a Lot in the Property; nor may any boats of any kind nor any type of vehicle, powered or unpowered, while it is being repaired, being stored, or parked on any Lot or street except while parked in a closed garage. No vehicles may be parked overnight on a road or street.”

Towing of cars will be done by Titan Towing Company as posted on the sign at the entrance to Windemere. Titan Towing’s impound lot is located approximately 12 miles from Windemere. Titan Towing’s telephone number is (817) 804-0334.
The owner of the towed vehicle is responsible for paying the towing company for all towing fees. Currently the initial towing fee for an automobile is $298.30. There are additional fees of $20.00 plus tax for each day the vehicle remains in impound storage for longer than 24 hours.
Windemere Homeowners Association, Inc. is not responsible for damages to a vehicle resulting from towing.
The Board of Directors of the Windemere Homeowners Association must take seriously enforcement of this Article.
Most Windemere residents will be unaffected by the changes to this policy.

- No changes to the exterior of Windemere homes/garden gates shall be made without prior ARB approval.
- To assure uniformity in the aesthetic appearance to all properties, a palette of earth tone exterior paint colors may be obtained from the current ARB chairperson listed in the WHOA Directory.
- Roofing tiles will be subject to the approved earth-tone colors.
- Approved wrought iron gate designs may be obtained through the ARB.
- Common Areas are maintained by the Association. Individual homeowners are restricted from installing or removing plants/structures of any kind in the common areas without prior written permission from the ARB.
- Requests for exceptions to the rules must be made, in writing, to the ARB or the Board of Directors, as applicable.
Garage Sales – No more than two (2) per year.
Signage
- Garage sale signs – Two signs permitted: one posted at Castlewood Lane entrance and one posted at residence of sale. Signs may be posted in the common areas the morning of sale and must be promptly removed at the conclusion of sale.
- Real Estate signs - One sign, not to exceed 2’ x 3’, may be used to advertise the sale of a property.
- Political signs may be posted on private property only (within Windemere property owner’s garden wall) and must be removed within 10 days after an election. No political signs may be posted in the common area.
- Maintenance signs (Roofing-Painting, etc.) are not allowed in the common area.
Pets
- Bag & properly dispose of pet feces.
- Keep pets leashed at all times when walking outside your property.
- Control incessant day/night barking.
Lighting
- Dusk-to-dawn fixtures are required to ensure our streets and alleyways remain continuously illuminated and secure during evening hours.
- Motion activated fixtures are not acceptable. Front/back light fixtures are the responsibility of each homeowner and should be kept in good working condition. Burned out bulbs should be replaced promptly.

- Only rubber-soled shoes can be worn on the courts.
- In-line / roller skates, skateboards, and bicycles / tricycles are prohibited.
- Courts must be left in good condition after use.
Non-resident Windemere Homeowners may use the pool and courts, provided they pay a $35.00 key deposit and a $140.00 annual user fee.
Parking Restrictions
- Inoperable vehicles of any kind cannot be stored / parked on Windemere streets, lots or garage aprons. Short-term (meaning less than a day) maintenance repairs are allowed on garage aprons. Vehicles must be garaged for long-term repairs.
- No parking is allowed in alleyways or grassy areas along alleyways.
- Garage aprons - Parking is permitted for brief periods of time; permanent parking on garage aprons is not allowed.
- Towing - In accordance with the Windemere Homeowners Association Towing Policy, vehicles will be towed, at owner’s expense, if found parked on streets/garage aprons during the hours of midnight to 5:00 a.m.

This includes:
- Unauthorized parking on Windemere streets between 12 midnight and 5 am
- Unauthorized parking on Windemere alleys or driveways at any time
- Inoperable vehicles (This is defined as any vehicle in need of repairs and/or not legally operable on city streets. This includes out-of-date registration tags.)
- Parking in a manner that poses a safety hazard or hinders the normal use of streets or alleys
- All boats
